INTERPRETATION OF RESULTS AND VERBAL STATEMENT OF COMBINED FORENSIC EXAMINATION IN CIGARETTE SMUGGLING CASE

Smuggling of tobacco products and their illegal circulation occupies most of the shadow economy in Lithuania. According to the results of the study of empty packs of cigarettes, the company “Nielsen” found that the amount of contraband cigarettes smoked in Lithuania in 2016 constituted 17.5 %*. Amount of illegally smoked cigarettes (%, in curve) and tax losses are presented on the Fig. 1.

The main reason for smuggling is the difference in the price of tobacco products in the EU and non-EU neighboring countries. For example, in Belarus, a pack of the most popular cigarettes costs about 0.5 euro, while the retail price of a pack of the most popular cigarettes in Lithuania is about 4-5 times higher. Smuggling of cigarettes accounts for 90 % of all smuggling cases recorded by the State Border Guard Service. In 2014, the officers of the State Border Guard Service detained almost 2 mln, in 2015 - more than 2 mln, in 2016 - more than 1 mln packs of contraband cigarettes. Most of the cigarette smuggling cases have been recorded on the border with Belarus (Fig. 2) State Border Guard Service at the Ministry of the Interior of the Republic of Lithua-nia 2016 activity report - 2016 March. Smuggled cigarettes are transported hidden inside of cars and trailers, floated across the border along the Nemunas River, and bundles with cigarettes are carried over across the border by people. In the latter cases, cigarettes are packed in plastic bags with self-made handles from improvised materials - ribbons, ropes, etc. The bundles are carried in the form of a backpack or a shoulder yoke. When smugglers cannot be caught red-handed and suspects are detained using service dogs and operational data, their involvement in smuggling must be proved. In these cases, the assistance is provided by experts from the Forensic Science Center of Lithuania. The question of the contact between the clothing of suspected person and the bundle of cigarettes, as well as between the car and bundles is of the main importance.

It should be noted that in the case under consideration, the prompt actions of border guards, timely withdrawal of research objects and nature of the objects Paigozinas V. Brussels, 2013.themselves, their handicraft production - all this allowed us to conduct a complete combined study of materials, and to make positive categorical conclusion that there was contact between submitted objects.

On 2 November 2016, the border guards in the forest near an abandoned house found a hidden bundle with packs of cigarettes “Gold Super Slims” with excise marks of the Republic of Belarus. The bundle was wrapped in black plastic, self- made handles in the form of ribbons and ropes were attached to it imitating a backpack. The service dog led the border guards to the village and a suspect was detained there.

The examination of submitted items was carried out using classical and modern instrumental methods The Manual of the Best Practice for the Forensic Examination of fibres. - ENFSI, 2013; The Manual of the Best Practice for the Forensic Examination of Paint. Brussels. - ENFSI, 2009.: low power microscopy (stereoscopic microscope Nicon SMZ1000, magnification 20^x-80^x) and high power, polarized microscopy (biological microscope Nikon Eclipse 50i, magnification 200^x-400^x), Fourier Transform Infrared spectroscopy (Bruker FT-IR spectrometer Tensor II coupled with FT-IR microscope Hyperion 2000), microchemical analysis of fiber dyes, plastics and paints (qualitative reactions performed using concentrated inorganic acids and reduction-oxidation reactions).

The suspect's jacket and self-made handles removed from the bundle were submitted for examination. Self-made handles (Fig. 3) consisted of 3 ribbons with a rope. Ribbon No 1 was made of a piece of white fabric (100 % polyester fibers) which was stitched with red and blue stitches. Inside the ribbon was a purple color filling material (100 % polypropylene fibers). Ribbon No 2 was made of a piece of blue fabric (100 % polyester fibers), a fragment of a gray color rope twisted from polypropylene strips was attached to one end. Ribbon No 3 was about 160 cm long, the fabric of the ribbon consisted of polyester fibers of orange, brown and white colors.

When an external examination of the suspect's jacket (Fig. 4) was made, it was found that the jacket consisted of artificial suede (100 % polyester microfibers, thickness 3 pm), the black paint finish being on the suede's surface. The inner side of the jacket, collar and cuffs was made of artificial fur (100 % acrylic fibers). The jacket was decorated with strips of artificial leather, in many places the plastic of strips was worn out.

On the self-made handles microscopic search for microparticles matching the microparticles from the jacket was performed and vice versa - on the jacket was performed a search for microparticles matching the microparticles from the self- made handles. In addition, a search for the same foreign microparticles (not included in the composition of submitted objects) was conducted.

It was determined that various microparticles (fibers, microparticles of paint, plastic) which corresponded to complete composition of the suspect's jacket were found on the presented self-made handles:

— tufts of brown polyester fibers matching the brown polyester fibers of artificial suede from the suspect's jacket by color, structure, thickness, type and class of fibers, polymer composition, color changes (or stability) in specific reagents and chemical class of dyes (Fig. 5);

— single tuft of brown polyester fibers with black paint microparticles on its surface. The black paint matched the paint of artificial suede's finishing of the suspect's jacket according to color, morphological features and chemical composition: binders, pigments and fillers (Fig. 6);

— microparticles of brown plastic matching the plastic of artificial leather from the decor strips of the suspect's jacket by color, morphological features and chemical composition: polymer, pigments and fillers (Fig. 7);

two types of yellowish brown acrylic fibers (delustred fibers with diameter 110 pm and non-delustred fibers with diameter 60 pm) matching the fibers of the suspect's jacket artificial fur according to color, shade, structure, thickness, typeand class of fibers, polymer composition, color changes (or stability) in specific reagents and dyeing with the same chemical class dye mixture (Fig. 8, 9).

On the other hand, microparticles (fibers of two types, plastic microparticles) which were consistent with the fibers of the two ribbons and the plastic of the rope were found on the suspect's jacket:

-- purple color polypropylene fibers matching the fibers of filler from the ribbon No1 by color, structure, thickness, type and class of fibers, polymer composition (Fig. 10);

-- microparticles of gray color plastic matching the gray color plastic of rope, attached to the ribbon No 2, according to color, morphological features and chemical composition: polymer, pigments and fillers (Fig. 12).

Moreover, two types of the same foreign microparticles were found on the suspect's jacket and self-made handles:

-- microparticles of red paint matching by color, morphological features and chemical composition: binder, pigments and fillers (Fig. 13);

It should be noted, that foreign microparticles, such as textile fibers, soil, peat were also detected in other forensic examinations of cigarette smuggling performed in our lab.

For the interpretation of forensic examination results, the following verbal statement scale (Fig. 15) is used in the Department of Examination of Materials and Other Objects of the Forensic Science Center of Lithuania: negative categorical conclusion - “no”, “cannot be determined”, “weak probability”, “moderate probability”, “high probability”, “very high probability”; positive categorical conclusion - “yes”.

Following requirements must be satisfied to formulate a positive categorical conclusion that the contact among submitted objects has occurred¹:

— cross-transfer of microparticles must be found on the objects under investigation;

— material composition of the investigated objects must be diverse and numerous;

— recovered microparticles must correspond to the larger part of material composition of the investigated objects;

— presence of matching foreign microparticles (textile or other origin) individualizing the interacting system must be defined.

In this particular case, cross-transfer of microparticles and the same foreign microparticles were found on the objects under investigation (Fig. 16). The diversity of recovered microparticles corresponded to the larger part of material composition of the investigated objects. Summarizing the totality of findings of combined forensic examination and estimating that all the requirements for solving this issue have been fulfilled, the conclusion was made that the suspect's jacket and self-made handles removed from the bundle had been in contact. The present case study demonstrates the impact of forensic experts in cigarette smuggling cases investigation and reinforces the importance of close cooperation between forensic science and pre-trial investigation institutions.

ИНТЕРПРЕТАЦИЯ И ВЕРБАЛЬНАЯ ОЦЕНКА РЕЗУЛЬТАТОВ КОМПЛЕКСНОЙ КРИМИНАЛИСТИЧЕСКОЙ ЭКСПЕРТИЗЫ В ДЕЛЕ О КОНТРАБАНДЕ СИГАРЕТ

Контрабанда табачных изделий и незаконное их обращение занимают большую часть теневой экономики в Литве. По результатам исследования пустых пачек сигарет компанией Nielsen установлено, что в 2016 г. контрабандные сигареты составляли 17,5 %. Главная причина контрабанды - различие в цене табачных изделий в странах ЕС и не входящих в ЕС соседних странах. Например, в Белоруссии пачка самых популярных сигарет стоит около 0,5 евро, а в Литве розничная цена такой пачки примерно в 4-5раз выше. Контрабанда сигарет составляет 90 % всех случаев контрабанды, зафиксированной Службой пограничной охраны. Большинство случаев контрабанды сигарет зафиксировано на границе с Белоруссией.

В статье представлен пример комплексного экспертного исследования, проведенного в связи с расследованием уголовного дела о контрабанде сигарет.

2 ноября 2016 г. пограничники в лесу, около заброшенного дома, обнаружили спрятанную связку, в которой были пачки сигарет Gold Super Slims с акцизными знаками Республики Беларусь. Связка была обернута в черный полиэтиленовый мешок, к ней были прикреплены самодельные ручки в виде лент и веревок, имитируя рюкзак. Служебная собака привела пограничников в село, где было задержано подозреваемое лицо.

На исследование были представлены куртка подозреваемого и самодельные ручки, снятые со свертка:

— самодельные ручки состояли из трех лент с веревкой;

— куртка подозреваемого была из искусственной замши, состоящей из полиэфирных микроволокон (3 мкм), поверхность замши окрашена краской черного цвета. Внутренняя сторона куртки, воротник и манжеты из искусственного меха, состоящего из акриловых волокон. Куртка декорирована ленточками из искусственной кожи, пластик искусственной кожи во многих местах истерт.

На представленных к исследованию самодельных ручках был проведен поиск микрочастиц, одинаковых с микрочастицами куртки, и наоборот - на куртке был проведен поиск микрочастиц, одинаковых с микрочастицами самодельных ручек. Кроме того, был проведен поиск одинаковых посторонних (не входящих в состав исследуемых объектов) микрочастиц.

В исследовании использовались такие методы: микроскопическое исследование, инфракрасная Фурье-микроспектроскопия, микрохимическое исследование красителей.

На самодельных ручках обнаружены микрочастицы (волокна, микрочастицы краски, пластика), которые полностью соответствовали составу материала куртки подозреваемого.

На куртке подозреваемого были обнаружены микрочастицы (волокна двух типов, микрочастицы пластика), одинаковые с волокнами двух лент и пластиком веревки.

Кроме того, на куртке и ручках обнаружены два типа одинаковых посторонних микрочастиц: микрочастицы красной краски и листья торфяного мха - сфагнума остроконечного (Sphagnum cuspidatum).

В Отделе экспертиз веществ и изделий Центра судебной экспертизы Литвы для интерпретации результатов исследований используется такая вербальная шкала оценки: отрицательный категорический вывод, не представляется возмож- нымустановить, малая степень вероятности, вероятно, высокая степень вероятности, очень высокая степень вероятности, положительный категорический вывод.

Для формулирования положительного категорического вывода о факте контактного взаимодействия объектов необходимо выполнение таких условий:

— на исследуемых объектах должен быть установлен двусторонний (взаимо- переходящий) перенос микрочастиц;

— состав исследуемых объектов должен быть разнообразным и многочисленным по видовому и цветовому составу;

— перенесенные микрочастицы должны соответствовать большей части состава исследуемых объектов;

— наличие одинаковых посторонних микрочастиц (волокнистого или другого происхождения), индивидуализирующих взаимодействующую систему.

Обобщив совокупность установленных признаков и оценив то, что удовлетворены все условия для решения вопроса о контактном взаимодействии, в этом конкретном случае сделан вывод, что представленные на исследование объекты - самодельные ручки, изготовленные из трех лент с веревкой, которые сняты со свертка, контактировали с курткой подозреваемого.

ІНТЕРПРЕТАЦІЯ Й ВЕРБАЛЬНА ОЦІНКА РЕЗУЛЬТАТІВ КОМПЛЕКСНОЇ КРИМІНАЛІСТИЧНОЇ ЕКСПЕРТИЗИ В СПРАВІ ПРО КОНТРАБАНДУ СИГАРЕТ

Контрабанда тютюнових виробів і незаконний їх обіг займають більшу частину тіньової економіки в Литві. За результатами дослідження порожніх пачок сигарет компанією Nielsen установлено, що у 2016р. контрабандні сигарети становили 17,5 %. Головна причина контрабанди - відмінність у ціні тютюнових виробів у країнах ЄС і сусідніх країнах, що не входять до ЄС. Наприклад, у Білорусії пачка самих популярних сигарет коштує близько 0,5 євро, а в Литві роздрібна ціна такої пачки приблизно в 4-5 разів вище. Контрабанда сигарет становить 90 % усіх випадків контрабанди, зафіксованою Службою прикордонної охорони. Більшість випадків контрабанди сигарет зафіксовано на кордоні з Білорусією.

У статті надано приклад комплексного експертного дослідження, проведеного у зв'язку з розслідуванням кримінальної справи про контрабанду сигарет.

2 листопада 2016 р. прикордонники в лісі, біля покинутого будинку, виявили схований згорток, у якому були пачки сигарет Gold Super Slims з акцизними знаками Республіки Білорусь. Згорток був загорнений у чорний поліетиленовий мішок, до нього були прикріплені саморобні ручки у вигляді стрічок і мотузок, які імітували рюкзак. Службовий собака привів прикордонників у село, де була затримана підозрювана особа.

На дослідження були надані куртка підозрюваного й саморобні ручки, зняті зі згортка:

— саморобні ручки складалися із трьох стрічок із мотузкою;

— куртка підозрюваного була зі штучної замші, що складається з поліефірних мікроволокон (3 мкм), поверхня замші пофарбована фарбою чорного кольору. Внутрішня сторона куртки, комір і манжети зі штучного хутра, що складається з акрилових волокон. Куртка декорована стрічечками зі штучної шкіри, пластик штучної шкіри в багатьох місцях стертий.

На наданих на дослідження саморобних ручках був проведений пошук мікрочастинок, однакових із мікрочастинками куртки, і навпаки - на куртці був проведений пошук мікрочастинок однакових із мікрочастинками саморобних ручок. Крім того, був проведений пошук однакових сторонніх (що не входять до складу досліджуваних об'єктів) мікрочастинок.

У дослідженні використовувалися такі методи: мікроскопічне дослідження, інфрачервона Фурье-мікроспектроскопія, мікрохімічне дослідження барвників.

На саморобних ручках виявлені мікрочастинки (волокна, мікрочастинки фарби, пластику), які повністю відповідали складу матеріалу куртки підозрюваного.

На куртці підозрюваного були виявлені мікрочастинки (волокна двох типів, мікрочастинки пластику), однакові з волокнами двох стрічок і пластиком мотузки.

Крім того, на куртці й ручках виявлено два типи однакових сторонніх мікрочастинок: мікрочастинки червоної фарби та листи торф'яного моху - сфагнуму шпичастого (Sphagnum cuspidatum).

У Відділі експертиз речовин і виробів Центру судової експертизи Литви для інтерпретації результатів досліджень використовується така вербальна шкала оцінювання: негативний категоричний висновок, не є можливим установити, малий ступінь імовірності, імовірно, високий ступінь імовірності, дуже високий ступінь імовірності, позитивний категоричний висновок.Для формулювання позитивного категоричного висновку про факт контактної взаємодії об'єктів необхідне виконання таких умов:

— на досліджуваних об'єктах має бути встановлене двостороннє (взаємопе- рехідне) перенесення мікрочастинок;

— склад досліджуваних об'єктів повинен бути різноманітним і численним за видовим і колірним складом;

— перенесені мікрочастинки повинні відповідати більшій частині складу досліджуваних об'єктів;

— наявність однакових сторонніх мікрочастинок (волокнистого або іншого походження), що індивідуалізують взаємодіючу систему.

Узагальнивши сукупність установлених ознак і оцінивши те, що виконані всі умови для вирішення питання про контактну взаємодію, у цьому конкретному випадку зроблено висновок, що надані на дослідження об'єкти - саморобні ручки, виготовлені із трьох стрічок із мотузкою, які зняті зі згортка, контактували з курткою підозрюваного.
